1. About Our Services

Just In Time Delivery Solutions, LLC provides final-mile delivery services for building materials, flooring, cabinetry, stone, hardscape, and related products in the Tampa Bay and Central Florida area. Our services include:

• White Glove / In-Home Delivery: two-man crew, scheduled windows, inside room-of-choice placement
• Garage / First Dry Space Delivery: controlled drop into garage or first covered dry space
• Curbside Delivery: property line or driveway exterior delivery
• Forklift / Jobsite Delivery: one-man mounted forklift, accurate jobsite material placement
• Forklift 4 Hire: on-demand forklift services with a skilled operator

2. Quotes and Pricing

2.1 Nature of Quotes — Estimates Only

2.2 Quote Validity

Quotes are valid for thirty (30) days from the date of issuance. After the expiration date, rates are subject to change without notice.

2.3 Scope of Work — Customer Responsibility

You are responsible for accurately describing the scope of work when requesting a quote. This includes:

• The correct number of pallets and estimated weight
• The presence of stairs at the delivery location and the number of flights and steps involved
• Whether elevator use is required
• Whether items are oversized (72 inches or longer) or overweight (2,500+ lbs per pallet for box truck; 4,200+ lbs per pallet for forklift)
• Whether the delivery site has limited access, gating, or unusual conditions
• Whether after-hours, weekend, or rush service is required
• The accurate pickup and delivery addresses

If the actual scope of work differs materially from what was represented in the quote request, JIT Delivers reserves the right to adjust the final price accordingly.

2.4 Quote Disclaimer — The Record of Selection

The quote confirmation email sent to you constitutes the official record of the service options and scope of work you selected. In the event of any dispute regarding services requested versus services delivered, the selections recorded in the quote confirmation email will serve as the primary reference document.

JIT Delivers is not responsible for service-level discrepancies that arise from inaccurate or incomplete information provided by the customer at the time of quoting.

2.5 Rate Review Requests

If you believe your quote contains an error, you may request a rate review by contacting us at sales@jitdeliversit.com or (813) 677-3209. Rate review requests are for clarification and correction purposes only. JIT Delivers does not engage in price matching with competitors.

2.6 Special and Account Pricing

Certain business accounts may be eligible for account-level pricing arrangements. Special pricing is applied automatically when a qualifying account user submits a quote through the Customer Portal. Special pricing arrangements are confidential and may be modified or discontinued at any time with reasonable notice.

3. Booking and Confirmation

3.1 How to Book

A quote does not constitute a booking. To confirm a delivery, contact JIT Delivers at (813) 677-3209 or sales@jitdeliversit.com and reference your quote number. A booking is confirmed only when you receive a written booking confirmation from JIT Delivers.

3.2 Scheduling

Delivery windows are scheduled at the time of booking based on availability and are subject to change due to operational factors, weather, traffic, or other circumstances outside our control.

3.3 Cancellation and Rescheduling

Cancellations or rescheduling requests must be submitted at least 24 hours before the scheduled delivery window. Requests made less than 24 hours before the scheduled delivery may be subject to a cancellation fee of up to 25% of the quoted delivery total. Same-day cancellations after dispatch has occurred will be billed at the full quoted rate.

3.4 Missed or Failed Deliveries

If a delivery cannot be completed due to circumstances attributable to the customer — including inaccessible location, no authorized person present, incorrect address, or unsafe site conditions — a redelivery fee of 25% of the original quoted amount will apply.

4. Delivery Conditions and Limitations

4.1 Jobsite Readiness

For Forklift/Jobsite deliveries, the customer is responsible for ensuring the job site is ready to receive the delivery at the scheduled time, including adequate access for the delivery vehicle, a safe and stable surface for forklift operation, and any necessary permits or access credentials. Delays caused by site unreadiness may result in wait time charges.

4.2 Service Area

JIT Delivers provides standard delivery services within Tampa Bay and Central Florida, including Hillsborough, Pinellas, Pasco, Manatee, Sarasota, and Polk counties and surrounding areas. Deliveries outside our standard service area are available upon request and are subject to additional pricing review.

4.3 Forklift 4 Hire — Dispatch Origin and Mileage

Forklift 4 Hire services are dispatched from 8215 Rebels Road, Riverview, FL 33569. Mileage is calculated from this dispatch location to the job site. Jobs exceeding 25 miles are subject to a mileage overage charge. Jobs exceeding 40 miles are subject to an additional deadhead return mileage charge.

4.4 Oversized and Overweight Items

Oversized items: any single item measuring 72 inches (6 feet) or longer. Overweight items: pallets weighing 2,500–3,100 lbs for box truck delivery, or up to 4,200 lbs for forklift delivery. These items are subject to additional handling charges and may require review before a final price is confirmed.

4.5 High-Difficulty or Specialized Scope

Complex delivery scenarios may not be fully priceable through our standard quote tool. For these situations, we reserve the right to provide a custom quote following an on-site assessment or detailed telephone consultation.

5. Liability and Damage Claims

5.1 Cargo Liability

JIT Delivers is fully licensed and insured. In the event of damage to goods caused by our crew's negligence, customers must report the damage in writing within 48 hours of the delivery date by emailing sales@jitdeliversit.com. Claims submitted after 48 hours may not be eligible for compensation.

5.2 Customer Responsibility for Accurate Information

JIT Delivers is not liable for:

• Damage resulting from inaccurate information provided by the customer
• Pre-existing damage to goods not noted before delivery
• Damage caused by improper packaging or inadequate preparation by the shipper
• Indirect, consequential, or incidental damages of any kind

5.3 Limitation of Liability

To the fullest extent permitted by applicable law, JIT Delivers' total liability for any claim shall not exceed the total amount paid by the customer for the specific delivery giving rise to the claim.

5.4 Force Majeure — Events Beyond Our Control

JIT Delivers shall not be liable for any failure or delay in performing our services resulting from circumstances beyond our reasonable control, including but not limited to:

• Acts of God, natural disasters, hurricanes, flooding, severe weather, or other extreme weather events
• Fire, explosion, or acts of vandalism
• Road closures, traffic accidents, or infrastructure failures
• Fuel shortages or supply chain disruptions
• Government actions, regulations, orders, or restrictions
• Labor disputes, strikes, or work stoppages
• Pandemic, epidemic, or public health emergency declarations
• Power outages or telecommunications failures
• Any other event that could not have been reasonably anticipated or prevented

In such circumstances, we will make reasonable efforts to notify you promptly and to reschedule your delivery at the earliest available opportunity. No cancellation fees will apply to deliveries that cannot be completed due to a force majeure event.

5.5 Third-Party Supplier and Vendor Disclaimer

JIT Delivers is a delivery service provider only. We are not responsible for:

• The quality, condition, completeness, or accuracy of the goods we are engaged to deliver
• Damage to goods that occurred prior to our taking possession for delivery
• Manufacturer defects, product recalls, or warranty issues related to delivered goods
• Incorrect items shipped by the supplier or sender
• Shortages or discrepancies in quantity that existed before delivery
• Any claims arising from the purchase transaction between you and your supplier

Our responsibility begins when we take physical possession of the goods for delivery and ends upon completion of delivery and proof of delivery documentation.

5.6 Customer-Caused Delays and Additional Costs

JIT Delivers is not liable for costs, losses, or damages arising from delays or additional work caused by:

• Inaccurate or incomplete information provided at the time of booking or quoting
• A delivery site that is not ready, accessible, or safe at the scheduled delivery time
• Failure to have an authorized person present to receive the delivery
• Changes to delivery scope requested after dispatch
• Incorrect delivery address provided by the customer
• Access restrictions, gated communities, or security requirements not disclosed at booking
• Elevator or stair access limitations not disclosed at the time of quoting

Any additional time, labor, or mileage incurred as a result of the above circumstances will be billed at our standard applicable rates.

5.7 Disclaimer of Consequential Damages

To the fullest extent permitted by applicable Florida law, JIT Delivers shall not be liable for any of the following, regardless of whether we were advised of the possibility of such damages:

• Lost profits or lost revenue
• Loss of business opportunity
• Project delays or construction schedule overruns caused by delayed or failed delivery
• Labor costs or crew standby costs incurred by the customer while waiting for a delivery
• Cost of expedited replacement materials ordered due to delivery issues
• Any indirect, incidental, special, punitive, or consequential damages of any kind

This limitation applies whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory.

5.8 Indemnification

You agree to indemnify, defend, and hold harmless Just In Time Delivery Solutions, LLC and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of our website or services
• Your violation of these Terms
• Inaccurate or misleading information you provided in connection with a quote or booking
• Your violation of any third party's rights, including the rights of delivery recipients whose information you submitted to us
• Any claim by a third party related to goods we delivered on your behalf

5.9 Website and Technology Disclaimer

Our website and InstantQuote tool are provided on an "as is" and "as available" basis. JIT Delivers makes no warranties, express or implied, regarding:

• The accuracy, completeness, or reliability of instant quote estimates
• The uninterrupted or error-free operation of our website or Customer Portal
• The accuracy of mileage calculations generated by third-party mapping services
• The compatibility of our website with your specific device or browser

We reserve the right to modify, suspend, or discontinue any feature of our website at any time without notice or liability.

5.10 No Warranty for Third-Party Services

Our services rely on third-party platforms including Google Maps, HouseCall Pro, and Supabase. We make no warranty regarding the performance, availability, or accuracy of these third-party services. Any disruption to these services that affects our ability to generate quotes, send emails, or process bookings does not constitute a breach of our obligations to you.

5.11 Florida-Specific Liability Disclaimer

Some states do not allow the exclusion or limitation of certain warranties or damages. To the extent that Florida law limits the enforceability of any of the above disclaimers or limitations, those provisions shall be modified only to the minimum extent necessary to comply with applicable law. All other provisions shall remain in full force and effect.

6. Customer Portal — Additional Terms

6.1 Account Security

You are responsible for maintaining the confidentiality of your Customer Portal login credentials. Notify us immediately at sales@jitdeliversit.com if you suspect unauthorized access. JIT Delivers is not liable for any loss resulting from unauthorized access due to your failure to secure your credentials.

6.2 Company Account Users

If you are a team member added to a company account, your quote history is visible to the designated account administrator at JIT Delivers. Individual team members cannot see other team members' quote activity.

6.3 Account Termination

JIT Delivers reserves the right to suspend or terminate Customer Portal access for any account that violates these Terms, engages in fraudulent activity, or is inactive for more than 24 months.

7. Website Use

7.1 Acceptable Use

You agree not to:

• Attempt to gain unauthorized access to any part of our website or systems
• Submit false or misleading information through our quote form
• Use automated tools to scrape, copy, or extract data from our website
• Interfere with the operation of our website or services
• Use our website in any manner that could damage our reputation or that of our business partners

7.2 Intellectual Property

All content on this website is the property of Just In Time Delivery Solutions, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Dispute Resolution

8.1 Informal Resolution

Contact us first at (813) 677-3209 or sales@jitdeliversit.com to resolve any dispute informally. We are committed to resolving disputes fairly and promptly.

8.2 Governing Law

These Terms shall be governed by the laws of the State of Florida. Any legal action shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida.

8.3 Waiver of Class Action

Any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

9. Modifications to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms with a new effective date. Continued use of our services after the effective date constitutes acceptance.

10. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Just In Time Delivery Solutions, LLC regarding your use of our website and services.

13.1 Quote Accuracy Disclaimer

Delivery quotes are generated algorithmically based on information provided by the customer. While we make every effort to ensure our pricing engine is accurate, JIT Delivers makes no guarantee that any instant quote reflects the final billable amount. Quotes are starting points for a service conversation — not binding price commitments. All quotes are subject to verification and confirmation upon booking.

13.2 No Guarantee of Availability

Generating a quote does not guarantee availability of delivery services on your requested date. Service availability is confirmed only at the time of booking.

13.3 Address and Mapping Disclaimer

Distance and mileage estimates used in our pricing calculations are generated by Google Maps services and may differ from actual driving distances. JIT Delivers is not responsible for pricing discrepancies arising from mapping inaccuracies. Final mileage for billing purposes is determined at the time of delivery based on actual route driven.

13.4 Photo Upload Disclaimer

Photos uploaded through our quote form are used solely for delivery preparation and scope verification purposes. JIT Delivers does not verify the accuracy of photos submitted and is not responsible for discrepancies between submitted photos and actual conditions at the delivery site.

13.5 Customer Portal Disclaimer

The JIT Delivers Customer Portal is provided as a convenience for tracking quote and delivery history. Information displayed in the portal is pulled from our internal CRM system and may not reflect real-time status updates. Portal status information should not be relied upon as a substitute for direct communication with our team for time-sensitive delivery matters.

13.6 Marketing Communications Disclaimer

Any promotional materials, case studies, testimonials, or marketing content produced by JIT Delivers represents typical results and experiences. Individual results may vary based on delivery scope, location, and other factors.
